REFUNDS & CANCELLATIONS

Miami Web AI is an AI systems and automation division of Nuko Nova Dynamics LLC, a Florida limited liability company ("Miami Web AI," "we," "us," or "our"). We provide digital services such as AI automation, AI voice agents, web design and development, and related consulting.

This Refunds & Cancellations Policy explains how refunds, cancellations, and billing disputes are handled for our services.

We only provide digital and professional services. We do not sell physical goods and do not accept returns of physical products.

1. SCOPE OF THIS POLICY

This policy applies to all paid engagements with Miami Web AI, including:

  • Project based services
  • Subscription and ongoing service plans
  • Strategy, consulting, and implementation work
  • Any trials, pilots, or promotions that lead to paid services

If you have a separate written agreement, master services agreement, order form, or Statement of Work (each, a "Contract") that has different terms regarding fees, billing, refunds, cancellations, or termination, that Contract will govern and will prevail over this Policy in the event of any conflict. For anything not expressly addressed in a Contract, this Policy applies.

Nothing in this Policy is intended to expand your refund or cancellation rights beyond what is stated in your Contract or required by applicable law.

All prices and charges are processed in United States Dollars (USD), unless expressly stated otherwise.

2. PROJECT BASED SERVICES

Project based services include work such as:

  • Web design and development projects
  • AI automation builds and integrations
  • AI voice agent implementations
  • One time strategy, architecture, or consulting engagements

2.1 DEPOSITS AND RETAINERS

Most projects begin with a deposit or retainer to reserve time in our schedule and cover initial planning and setup work.

Unless stated otherwise in your proposal or SOW:

  • Deposits and retainers are non refundable once we begin work on the project.
  • If you choose to cancel before we start work, we may refund your deposit in whole or in part at our reasonable discretion, taking into account any time and costs already incurred.

2.2 MILESTONE AND PHASE PAYMENTS

For projects with milestone or phase based billing:

  • Payments already made for completed milestones are not refundable.
  • For milestones that are in progress, we may provide a partial refund for uncompleted work at our reasonable discretion if you cancel the project.
  • If you are unhappy with the direction of a project, you must let us know as early as possible so we can address your concerns within the scope, time, and budget defined in the proposal or SOW.

2.3 CLIENT INITIATED CANCELLATION

If you decide to cancel a project before it is complete:

  • You remain responsible for payment of all work delivered up to the effective cancellation date.
  • Any unpaid invoices for completed work become due immediately.
  • We may provide a partial refund for work that has not yet begun, or offer a credit that can be applied to another Miami Web AI engagement, at our reasonable discretion.

2.4 MIAMI WEB AI INITIATED CANCELLATION

If we are unable to complete a project due to reasons within our control and we cancel the engagement, we will:

  • Provide a refund for fees you paid for work that has not been delivered, or
  • Offer an equivalent credit toward future services, if you prefer.

We are not responsible for delays or failures caused by events outside our control, such as changes to third party platforms, outages, force majeure events, or your failure to provide timely access, content, or approvals.

3. SUBSCRIPTION AND ONGOING SERVICE PLANS

Subscription and ongoing plans include services such as:

  • Monthly or annual support and maintenance plans
  • Continuous optimization or AI tuning services
  • Ongoing consulting or advisory retainers

3.1 BILLING

Unless stated otherwise in your specific plan:

  • Subscription fees are billed in advance of each billing period.
  • Billing is automatic using the payment method you provide.
  • Your subscription renews automatically at the end of each billing period until it is canceled.
  • We may change subscription fees from time to time. If we change pricing for an existing plan, we will provide notice in advance and the change will apply on your next renewal unless you cancel before that date.

3.2 CANCELLATIONS

You can request cancellation of your subscription at any time by:

  • Using the customer portal link we provide, or
  • Contacting us at billing@miamiweb.ai or hello@miamiweb.ai with your account details.

Unless a different rule is stated in your specific plan or SOW:

  • Cancellations take effect at the end of the current billing period.
  • We do not issue refunds for partial months or unused time within a billing period.
  • You will continue to have access to services included in your plan until the billing period ends.

3.3 NONPAYMENT AND SUSPENSION

If a payment fails and is not resolved within a reasonable time after we notify you, we may suspend or limit access to services until your account is brought current.

We are not responsible for any impact on your business that results from suspension due to nonpayment.

3.4 UPGRADES AND DOWNGRADES

If you upgrade your plan, the change may take effect immediately, with a prorated charge, or at the start of your next billing period. The specific behavior will be shown to you at the time of the change.

If you downgrade your plan, the change typically takes effect at the start of the next billing period. Some features or usage limits may be reduced when the downgrade becomes effective.

4. TRIALS, PILOTS, AND PROMOTIONS

From time to time we may offer free trials, pilots, discounted periods, or other promotions.

Any special terms for a trial or promotion will be clearly stated at the time of sign up. Unless those terms say otherwise, the following default rules apply:

  • Trials convert to a paid plan at the end of the trial period unless you cancel before the trial ends.
  • When a trial converts to a paid plan, your payment method on file will be charged at the then current rate for the selected plan.
  • Promotional pricing is valid only for the period stated and will renew at the then current standard price unless you cancel before the promotional period ends.
  • We reserve the right to modify or end a promotion at any time, but changes will not shorten a promotional period that you have already accepted.

5. BILLING ERRORS AND DUPLICATE CHARGES

If you believe you have been incorrectly billed or charged more than once for the same service, contact us as soon as possible at billing@miamiweb.ai.

Where we confirm a billing error or duplicate charge:

  • We will correct the error, and
  • Issue a refund or account credit for the incorrect amount, depending on what is appropriate in the situation.

6. DISPUTES AND CHARGEBACKS

We want to resolve issues directly with you whenever possible.

If you are considering disputing a charge with your bank or card issuer, we ask that you contact us first at billing@miamiweb.ai or hello@miamiweb.ai so we can review your account and attempt to resolve the matter.

Unfounded or abusive chargebacks may result in suspension or termination of services.

Nothing in this section limits your rights to dispute a charge with your bank or card issuer, but using our support channels first often leads to faster resolutions.

7. HOW TO REQUEST A REFUND OR CANCELLATION

To request a refund or to cancel a project, subscription, or other service, please contact us with:

  • Your full name
  • Your company name
  • The email address associated with your account
  • The invoice number or transaction ID
  • A brief description of your request and the reason

We review each request in line with this policy and any written agreement that applies to your engagement.

8. CHANGES TO THIS POLICY

We may update this Refunds & Cancellations Policy from time to time. When we make changes, we will revise the "Last updated" date at the top of the page.

If changes are material, we may also provide additional notice, such as by email or through your account, where appropriate.

Your continued use of our services after the updated policy becomes effective means you accept the revised policy.
